Facts
Seventeen-year-old Eric Gray (defendant), who had Asperger’s syndrome and was a registered sex offender, made multiple harassing calls to an adult woman who had worked for his mother. Gray texted the woman a picture of his erect penis with the message, “Do u like it babe? It’s for you. . . . And for your daughter babe. . . .” Gray was found guilty of second-degree dealing in depictions of a minor engaged in sexually explicit conduct in violation of Revised Code of Washington (RCW) 9.68A.050. The court of appeals affirmed. The Washington Supreme Court granted Gray’s petition for review. Gray argued that the statute did not apply to him because the person who dealt in the depictions had to be someone other than the depicted minor.
