Facts
Joseph Flores (defendant) and Vernon Green had a troubled relationship. Green moved from Nevada to New Mexico to get away from Flores and to live with Green’s parents. While driving with his mother in New Mexico, Green saw Flores drive up next to them at a stoplight. Green appeared agitated and scared and told his mother, “There’s Joseph.” A few days later, Flores killed Green. At trial, Green’s mother testified about Green’s statement. Green’s mother also identified Flores in court as the person she saw driving the vehicle next to them at the stoplight. Flores was convicted and appealed. On appeal, Flores claimed that Green’s out-of-court statement identifying Flores at the stoplight was inadmissible hearsay.
