State v. Goetz
Montana Supreme Court
191 P.3d 489 (2008)
- Written by Paul Neel, JD
Facts
A confidential informant, Suzanne Trusler, agreed to buy methamphetamine from Thaddeus Goetz (defendant). Police outfitted Trusler with a body wire to record the transaction. Trusler met Goetz at his home. Goetz did not know that Trusler wore a wire or that police were listening to his and Trusler’s conversation. The state (plaintiff) charged Goetz with felony distribution. Goetz moved to suppress the recording. The trial court denied the motion. Goetz was convicted and appealed.
