Facts
The State of Louisiana (plaintiff) alleged that Reginald Handy (defendant) raped his ex-girlfriend on November 9, 1997. A medical examination revealed that the victim had a vaginal abrasion/laceration, facial abrasions, and a bite mark on her neck. Swabs of the victim’s vaginal area did not reveal the presence of semen. Handy denied raping the victim. Prior to trial, Handy filed a motion seeking to present evidence of the victim’s prior sexual activity with Theo McGriff on the night of the alleged rape. McGriff admitted to having sex with the victim on that night, but he denied being rough with the victim and said that he did not hear the victim complain that he was being rough or hurting her. The trial court denied Handy’s motion, and Handy filed a pretrial writ with the Louisiana Court of Appeal seeking review of the trial court’s ruling.
