Facts
Corrections Officer Gary DuBois let several inmates out of their cells to clean the cell block. Shortly thereafter, DuBois was jumped by several of the inmates who hit him in the fact and took his keys and body alarm. Inmates Baldwin (defendant), Davis (defendant), Nemhart (defendant) and Roque (defendant) all struck DuBois. Ronell Hanks (defendant) kicked DuBois and then was told by Davis and Baldwin to look out for other corrections officers (collectively Defendants). Roque was charged with, and convicted of, conspiracy and the other Defendants were charged with, and convicted of, accessories to first-degree assault and attempted first-degree escape. Defendants appealed.
