Facts
Grady Harris (defendant) was arrested, charged with armed robbery, and held in jail. Six weeks after Harris’s arrest, officers transported Harris from the jail to a hospital for treatment. On the way to the hospital, Harris jumped out of the police car on an interstate exit ramp and tried to run away. However, the officers were able to capture him. At Harris’s armed-robbery trial, a lawyer for the prosecution (plaintiff) cross-examined Harris and asked Harris about his attempted escape. Harris’s counsel objected, and the trial court sustained the objection and told the jury to ignore the question. Harris’s counsel then moved for a mistrial, but the court denied the motion. The jury ultimately convicted Harris of armed robbery, and he appealed.
