Facts
Keyon Harrison (defendant) and Keith Collins robbed a marijuana dealer. Collins shot and killed the dealer during the robbery. Harrison, who was 16 years old at the time, was charged with first-degree felony murder and tried as an adult. The jury convicted Harrison, and he appealed to the Iowa Supreme Court. Harrison argued on appeal that by defining first-degree murder to include killings committed during a felony, Iowa’s felony-murder statute impermissibly created a conclusive presumption that a killing committed during a felony is committed with malice aforethought.
