Facts
On January 13, 1972, Fred W. Hokenson (defendant) entered a drug store with the intent to commit robbery. At the time he entered the store, Hokenson was armed with a homemade bomb. In the course of the attempted robbery, Hokenson attacked the store owner and the bomb fell to the ground. Police officers arrived and arrested Hokenson. Before leaving the scene, one of the officers picked Hokenson’s bomb up from the floor. The bomb exploded and killed the officer. Hokenson was convicted of first degree murder, and he appealed.
