Facts
Daniel Huset was convicted of criminal trespass, criminal damage, and disorderly conduct. Huset was sentenced to prison and ordered to pay the victim restitution for wages lost because of time spent in court and $1,500 for a damaged glass table. The victim was a realtor who earned money through commissions rather than hourly wages. The court calculated the victim’s lost wages by dividing the victim’s annual income to obtain an hourly wage and multiplying the hourly wage by an eight-hour workday for six days. The court based the amount of restitution for the damaged table on the victim’s testimony that a Google search revealed that the replacement value of the table that she purchased from a friend for $500 was $1,500. The court did not consider whether the table could be repaired rather than replaced. Huset appealed his conviction and the restitution award.
