Facts
Ibbison (defendant) was involved in a beach cleanup when he was stopped by Kay, a littoral property owner, and a police officer. Kay had marked his private property as extending to the mean-high-water line. Ibbison believed that the public were able to access the beach to the high-water line, which was farther inland than the mean-high-water line. The police officer arrested Ibbison for trespassing above the mean-high-water line. Ibbison was convicted of criminal trespass but successfully appealed his conviction. The state appealed to the Rhode Island Supreme Court.
