Facts
Todd Jadowski (defendant) was a 35-year-old man who had sexual intercourse with a 15-year-old girl. The victim told Jadowski and others that she was 19 years old, physically appeared to be at least 19, and showed Jadowski an apparently official identification card that stated her age as 19. Jadowski was charged with statutory rape. The circuit court allowed Jadowski to introduce evidence of the victim’s intentional misrepresentation of her age as an affirmative defense to the crime. The prosecution appealed.
