Facts
Truck driver Keyshawn Jones (defendant) requested a $1,200 payment from the trucking company’s payroll management account. The payroll processor accidentally typed $120,000, resulting in a deposit (after deductions) of $118,729.49 directly into Jones’s bank account. The processor realized the error the next morning, told Jones not to make any withdrawals, and tried to reverse the deposit. However, the reversal failed because Jones had already withdrawn almost all of the money. A jury found Jones guilty of larceny, and he appealed. The appellate court reversed the guilty verdict, reasoning that he did not commit a trespassory taking. The North Carolina Supreme Court granted the prosecution’s request for discretionary review.
