Facts
George Kelly (defendant) was driving his car at night while intoxicated. Kelly was driving on a two-lane road and attempted to pass a car on a curve in a no-passing zone. Kelly’s car collided with an oncoming car, killing a passenger in that car. Kelly was convicted of second-degree murder and appealed, alleging that the evidence did not support a second-degree murder conviction, but supported only a conviction for vehicular homicide.
