Facts
Brett Knott (defendant) was charged with obstruction of justice and tampering with evidence. The prosecution alleged that Brett helped his son, Eric Knott, destroy evidence of a murder that Eric had committed. At Brett’s trial, the prosecution (plaintiff) called Eric as a witness. The prosecution asked Eric if he recalled a conversation with Chris Wittkugle at the sheriff's office. Eric stated that he could not remember, and the court permitted the prosecution to refresh Eric’s memory with a recording of the conversation. The recording was played in the jury’s presence. The conversation on the recording implicated Brett. Brett was convicted, and he appealed.
