State v. Koivu
Idaho Supreme Court
272 P.3d 483 (2012)

- Written by Deanna Curl, JD
Facts
In March 2010, Koivu (defendant) was pulled over for speeding in Bonner County. A background check revealed that Koivu had an outstanding warrant in Boundary County. After taking Koivu into custody based on the outstanding warrant alone, officers found that he was carrying methamphetamine, and he was charged with possession. The Boundary County warrant that served as the basis of Koivu’s arrest was later found to be invalid. As a result, the trial-court judge found that evidence of the methamphetamine was obtained in violation of Koivu’s state constitutional rights and excluded its introduction at trial. The state (plaintiff) appealed the trial court’s ruling.
