Facts
After receiving a report of a shooting and information that Michael Lamb (defendant) was the shooter, police went to Lamb’s mother’s home, where Lamb reportedly resided. The police did not have a warrant, and Lamb’s stepfather emphatically refused to let the police into the home. While the police were talking with Lamb’s stepfather, Lamb’s girlfriend left the home and confirmed that Lamb was inside. Lamb’s stepfather later agreed to leave the home and, shortly thereafter, Lamb came out of the home as well. Lamb’s mother was still in the home and gave the police permission to search the room Lamb had been using. Police found a gun and ammunition during the search. At a subsequent trial on weapons offenses and other charges, Lamb filed a motion to suppress evidence related to the search.
