Facts
Seth Little (defendant) was charged with unlawful possession of methamphetamine in Grays Harbor County, Washington (the county). Little moved for dismissal of the charge based on the county’s lack of a drug court—a statutorily authorized court designed to reduce recidivism and substance abuse among nonviolent drug offenders. The superior court denied the motion. Little appealed, contending that a strict-scrutiny standard should be applied to his equal-protection argument. The Washington Court of Appeals granted certiorari.
