The State of Rhode Island (plaintiff) prosecuted police officer John Lough (defendant) for committing larceny by fraudulent conversion. Trial evidence established that another police officer confiscated a minibike from its owner and entrusted it to Lough, expecting that Lough would take it to the police station for storage. Instead, Lough discarded the minibike. A jury convicted Lough and an appellate court rejected his appeal. Lough appealed to the Rhode Island Supreme Court. Lough contended that the prosecution failed to prove that he converted the minibike to his own use.
