Facts
Robert Malone (defendant) fled from a police traffic stop, leading to a high-speed chase. During the chase, the police officer’s car collided with a vehicle driven by a third party, causing injuries to both parties. A grand jury found Malone guilty on multiple counts, including first-degree assault on the police officer and third-degree assault on the third-party motorist. Malone asserted that the officer had violated state law by failing to come to a complete stop at the intersection where the collision occurred. The superior court dismissed the two assault counts. The state of Alaska (plaintiff) appealed. The Alaska Court of Appeals granted certiorari.
