Facts
Michael Matusky (defendant) was charged with the murder of Gertrude and Pamela Poffel. At the time of the murder, Pamela’s estranged husband, Richard White, was engaged to be married to Rebecca Marchewka. At Matusky’s trial, White invoked his Fifth Amendment privilege against self-incrimination. Marchewka testified over Matusky’s objection that White had told her that he knew who had killed the Poffels and that the murderer was Matusky. The trial court admitted Marchewka’s testimony about White’s declaration in full. Matusky was convicted, and he appealed.
