Facts

On December 14, 1981, Wilbert Mayle (defendant) and Bobby Stacy robbed a McDonald’s restaurant. Approximately half an hour later, the two broke into a gasoline station. A police officer arrived at the scene and was killed. Mayle was found guilty of felony murder. He appealed.
