Facts
Alvin McCoy (defendant) was arrested, and the State of New Jersey (plaintiff) charged him with receiving a stolen vehicle. McCoy pleaded guilty to the offense and provided testimony as the factual basis for the plea. McCoy testified that he was walking when his friend drove by in a car. His friend called McCoy over, and McCoy was about to get into the car. McCoy knew that the car was stolen, and when he touched the car, a police officer attempted to arrest him. McCoy ran, but he was apprehended. McCoy testified that he intended to get into the car and ride around in it. McCoy moved to withdraw the guilty plea before sentencing, but the trial court denied the motion. McCoy appealed, and the court of appeals reversed. The state appealed.
