Facts
Thomas McKeiver (defendant) entered a bar with a handgun. McKeiver fired a shot into the bar’s ceiling and ordered the bar’s occupants to stand in one area and give him their wallets. McKeiver then ordered the people to walk to the other end of the bar. As the group was walking, one woman had a heart attack. Despite emergency attention minutes later, the woman died. The coroner ruled that a combination of coronary-artery disease and fright had caused the woman’s heart attack. McKeiver was charged with first-degree felony murder. McKeiver moved to dismiss the felony-murder charge, arguing that he could not be responsible for the woman’s death because he had not physically contacted the woman in any way.
