State v. Miller
Arizona Court of Appeals
755 P.2d 434 (1988)

- Written by Carolyn Strutton, JD
Facts
Jerry Farmer and Julie Hart stole 11 diamond rings from a store in Flagstaff, Arizona. They traveled to Colorado with the stolen rings and there met Allen Miller (defendant) for the first time. Farmer told Miller about the stolen rings, and Miller offered to help sell the rings in Las Vegas, Nevada. Farmer, Hart, and Miller went to Las Vegas and sold the rings. Miller kept two of the rings as payment for his help. Miller was eventually arrested in Utah and extradited to Arizona. He was charged with theft under an Arizona state statute. Miller was not an Arizona resident, had not entered Arizona with the rings, and only learned of the theft after the fact and outside of the state. Miller filed a motion to dismiss the charges for lack of jurisdiction, and the motion was granted. The state (plaintiff) appealed, alleging among other theories that it had jurisdiction because the sale of the stolen rings produced a result in Arizona.
