Facts
Gregory Nelson (defendant) lived with his sister, Georgia Stigler, and her husband, Reuben Stigler. One night, Nelson returned to his room to find that four of his guns, $1,000, and some other items had been stolen. Nelson told Georgia, who confronted Reuben. Georgia told Reuben that if the items were not returned by morning, the police would be contacted. Reuben subsequently went to a tavern with a friend, Russell Hill. There, they recovered three of the stolen guns and returned them to the house. At the house, Reuben and Hill were held at gunpoint by Nelson and others. This continued for several hours, during which time multiple phone calls were made to retrieve the stolen items. Reuben and Hill found a way to escape, and Nelson was arrested. Nelson was charged and convicted of false imprisonment. Nelson appealed his conviction, arguing that it was error for the trial court to deny his request for a jury instruction for the defense of defense of property.
