Facts
Ohio Oil Company (defendant) drilled six natural-gas wells in the State of Indiana (plaintiff). Ohio Oil failed to secure the wells to prevent the escape of natural gas within two days of completion as required by a state statute. Millions of cubic feet of natural gas were wasted from the state’s supply. Ohio Oil communicated its intention to continue allowing natural gas to escape from its wells indefinitely. The state’s residents and economy were heavily dependent on the state’s natural-gas supply. The State of Indiana brought an action against Ohio Oil seeking an injunction of its wasting of natural gas. The lower court found in favor of Ohio Oil. The state appealed.
