Facts
Olsen was a truck driver at an army base. She became sleepy while driving her truck to pick up some soldiers. She opened the truck windows in an attempt to wake herself up and kept driving. After stopping at a light, Olsen started driving again and then fell asleep. The truck drove up onto a sidewalk and struck and killed a child. Olsen was convicted of involuntary manslaughter. Olsen appealed, alleging that there was no evidence of negligence sufficient to send the charge to a jury.
