Facts
Michael Person (defendant) was convicted of murder. He appealed his conviction on the basis that the jury was improperly instructed on the affirmative defense of extreme emotional disturbance. Person maintained that the court misled jury members by failing to explain that they should take into consideration evidence of Person’s mental illness when deliberating what the jury instruction referred to as his “situation.”
