Facts
Ridley Mabrey (defendant) had an argument with his wife, Mrs. Mabrey. As Mrs. Mabrey attempted to walk away, Ridley grabbed her arm and threatened to kill her. Ridley then drew his knife and stabbed at Mrs. Mabrey but missed. Ridley drew back as if to strike again and was stopped by a bystander. Mrs. Mabrey fled. Ridley did not pursue her but told her not to return and that if she did, he would kill her. The trial court held that Ridley was not guilty of assault because no permanent injury was inflicted, and the state appealed.
