Facts
Chris Robertson (defendant) was convicted in federal court for possession of child pornography. The State of Utah (plaintiff) subsequently charged Robinson with sexual exploitation of a minor based on the same conduct. Robertson was convicted, and Robertson appealed to the Utah Court of Appeals, which affirmed the trial court’s decision. Robertson then appealed to the Utah Supreme Court, arguing that the state’s prosecution violated the state’s double-jeopardy statute.
