State v. Santana-Lopez
Wisconsin Court of Appeals
613 N.W.2d 918 (2000)

- Written by Sean Carroll, JD
Facts
Miguel Santana-Lopez (defendant) was charged with sexual assault of a minor. Prior to trial, Santana-Lopez had offered to take a DNA test to prove his innocence. At trial, the trial court ruled that Santana-Lopez could not testify about that offer because it was not relevant. Santana-Lopez argued that his state of mind about whether he was guilty or innocent at the time of the offer was relevant. The trial court disagreed. Santana-Lopez was convicted, and he appealed.
