State v. Sowry
Ohio Supreme Court
803 N.E.2d 867 (2004)
- Written by Carolyn Strutton, JD
Facts
Stephen Sowry (defendant) was arrested for disorderly conduct and resisting arrest, searched by the arresting officers, and transported to the county jail. At the jail, Sowry was asked if he was carrying any drugs. Sowry replied “no,” but a subsequent search revealed that he marijuana in his pocket. Sowry was charged with the crime of knowingly bringing drugs into a detention facility. Sowry moved for a judgment of acquittal, alleging that he was not criminally liable for the charge because his conduct in bringing the marijuana to the county jail was not voluntary. The trial court denied the motion, and Sowry was convicted. Sowry appealed on the same basis.
