Facts
A window was broken at a neighborhood center that operated a licensed childcare center and senior-citizen programs. A police officer responded to a report of an attempted break-in and arrested Vincent Sullivan (defendant), who was standing near the broken window and carrying a bag containing a hammer, a chisel, and gloves. The size of the window was about three feet by three feet. New glass had to be ordered, and a wood covering was used to cover the area where the window had been until the window was repaired two weeks later. The cost to repair the window was $571. Sullivan was convicted of vandalism and argued on appeal that the state (plaintiff) failed to present sufficient evidence to support the conviction.
