State v. Verive
Arizona Court of Appeals
627 P.2d 721 (1981)
- Written by Angela Patrick, JD
Facts
Lee Galvin was supposed to testify against Howard Woodall on a perjury charge. Woodall hired alleged mob enforcer Carl Verive (defendant) to go to Galvin’s house and beat him up in an attempt to dissuade Galvin from being a witness against Woodall. As agreed, Verive drove to Galvin’s house, told Galvin that Woodall had sent him, and beat up Galvin. Verive was convicted of (1) conspiracy to dissuade a witness and (2) attempt to dissuade a witness. Verive appealed, arguing that he could not be held criminally liable for both a conspiracy and an attempt to commit the same crime.
