Facts
Alonzo Smith and Lawrence Reed robbed a grocery store using a toy gun. Smith and Reed were arrested along with Angela Walden (defendant), who drove them from the scene of the crime. Testimony from Smith and Reed implicated both Walden and Benita Darby (defendant) in the robbery’s planning. Walden and Darby were charged with common-law robbery and conspiracy to commit robbery with a dangerous weapon. Darby moved to dismiss the charges against her, arguing that the evidence proffered by the state (plaintiff) was insufficient to support the charges. The motion was denied. Walden and Darby were convicted of common-law robbery as principals. Darby was also convicted on the conspiracy charge. Darby appealed. The North Carolina Court of Appeals granted certiorari.
