Facts
A confidential informant told police that an African American male was selling marijuana, cocaine, and heroin from a particular apartment in a public-housing project. Three officers dressed in plain clothes arranged a controlled buy at the apartment. Rashad Walker (defendant) opened the door while smoking a marijuana cigarette. One officer standing near the door noticed the smell of burning marijuana. Walker noticed one of the officers had a badge hanging around his neck. Walker flicked the cigarette into his apartment and tried to shut the door. The officers entered the apartment and arrested Walker. The officers saw in plain view and seized bags of marijuana, cocaine, and heroin from the apartment. The state (plaintiff) charged Walker. Walker moved to suppress the evidence. The trial court denied the motion, and Walker was convicted. Walker appealed.
