The State of Missouri (plaintiff) had an existing warrant for Ian Winsor’s (defendant) arrest. Police officers detained Winsor and sent him to county jail. A police officer found marijuana in the waistband of Winsor’s shorts while performing a routine preadmission search. Missouri charged Winsor with possession of a controlled substance on the premises of a county jail. After a bench trial, the court found Winsor guilty and sentenced him to a three-year suspended sentence. The court placed Winsor on five years of probation. Winsor appealed, arguing that there was insufficient evidence to support the conviction because he was not voluntarily on the premises of the county jail.
