Facts
Ryan Botticello (defendant) assaulted Chris Steele (plaintiff). Chris sued Botticello. Chris’s wife, Eryn Steele (plaintiff) knew about the lawsuit but did not participate in it. After Botticello and his insurer settled Chris’s lawsuit, Eryn filed a separate lawsuit against Botticello for loss of consortium. Eryn and Chris subsequently divorced. The trial court granted Botticello’s motion for summary judgment, reasoning that Eryn’s claim was barred by the settlement and release of Chris’s claim. Eryn appealed.
