Facts
News Group Publications, Inc. (NGP) (defendant) hired Tony Stephano (plaintiff), a professional model, to do a photo shoot for its magazine. NGP used two of the photos from the shoot in a September 1981 issue of its magazine. Prior to that, in an August 1981 magazine issue, NGP published an article about the release of a new Armani bomber jacket. The article described the jacket, its new release, and included information about its designer and where it could be purchased. With the article, NGP published a photo of Stephano from the photo shoot wearing the new jacket. Stephano sued for violation of his right of publicity and right of privacy, claiming that he gave his consent only for the September issue. The trial court granted NGP summary judgment. The appellate court reversed. NGP appealed.
