Facts
Stericycle, Inc. (defendant) established various company rules and regulations that prohibited certain employee conduct. For example, Stericycle prohibited employees from any conduct that maliciously or intentionally harmed Stericycle’s business reputation, or that constituted a conflict with the company’s interests. Stericycle required employees to keep any results of complaints and investigations confidential. Stericycle also prohibited employees from taking pictures and videos of any Stericycle property. A complaint was filed on behalf of Stericycle employees (plaintiffs) at the National Labor Relations Board (NLRB). The complaint alleged that the Stericycle rules violated § 8 of the National Labor Relations Act (the act) by impinging upon employees’ rights under § 7 of the act. Applying the analysis of the NLRB’s decision in The Boeing Company, the administrative-law judge (ALJ) ruled that Stericycle’s rules violated § 8. The NLRB reviewed the decision.
