Facts
The United States Supreme Court denied certiorari to petitioners appealing Stevens v. City of Cannon Beach, a decision of the Oregon Supreme Court that found when littoral property owners took title to their land, they were on notice that they did not gain exclusive use of dry-sand areas. This was because public use of the dry-sand areas was so notorious that notice of public custom and use was presumed as part of the area’s background property law.
