Facts
Frances Stewart (plaintiff) filed suit against her husband, Ernest Stewart (defendant), pursuant to the 1917 revisions of the California Code of Civil Procedure (Civil Code), seeking to establish that she currently held an undivided one-half interest in real community property that she and Ernest obtained in 1918. The trial court granted Frances’s request, giving her an undivided one-half interest in the community property. Ernest appealed.
