Facts
The Rock Island railway gave a “switch-key” to Mr. Stowell (defendant). This key opened all of the depot and freight doors in Stowell’s division. The railway did not impose any regulations regarding the key’s use. Stowell used the key to enter a freight warehouse, where he then stole two parcels. Stowell was convicted of burglary. He appealed.
