Facts
Strauss (plaintiff) learned that his childhood friend, Cilek (defendant), had been having an affair with his wife for over a year. During the affair, Strauss and his wife were having marital difficulties. Further, at the time Strauss filed suit against Cilek for intentional infliction of emotional distress (IIED), Strauss had filed for divorce from his wife. Cilek filed a motion for summary judgment. The trial court denied Cilek’s motion and held for Strauss. Cilek appealed.
