Facts
Dennis Streiff (plaintiff) was an insurance agent for American Family Insurance Company (defendant). Streiff’s employment contract stipulated that, upon termination, he would receive ongoing extended-earnings payments if he adhered to all other contractual provisions. One such provision, § 5h, imposed a one-year restriction on Streiff’s freedom to compete with American Family within a limited geographical area. Another provision, § 5i, conditioned Streiff’s right to receive extended earnings on his compliance with § 5h and on his refraining from any future competition with American Family, regardless of locale. When Streiff left American Family and took many of his clients to another company, American Family refused to pay Streiff any extended earnings. Streiff sued. The trial court entered summary judgment for American Family. An intermediate appellate court affirmed. Streiff appealed to the Wisconsin Supreme Court.
