Facts
Cook (defendant) got into a car accident with Stroud (plaintiff). Stroud brought suit for negligence. Prior to this civil trial, as a result of his role in the accident, Cook was convicted of failure to use due care in the operation of a motor vehicle, a misdemeanor. Stroud sought to introduce this conviction at trial. Cook filed a motion in limine attempting to exclude the conviction from evidence.
