Facts
Naomi Stroup (plaintiff) agreed to lease space in her commercial building to Dennis Conant (defendant) who informed Stroup he intended to sell “watches, wallets, gifts, and novelties.” Stroup learned later that Conant used the premises to open the “Birds & Bees Adult Book Store.” Stroup filed suit against Conant to rescind the lease arguing that he induced her into executing the lease arrangement under false pretenses. The trial court held for Stroup. Conant appealed.
