Facts
Alexander Styller (plaintiff) regularly rented out his home in Lynnfield, Massachusetts short-term using rental platforms like AirBnB. Somebody shot and killed a party guest at Styller’s house while it was rented for a three-day holiday weekend. After the murder, Lynnfield issued a cease-and-desist order preventing Styller from renting the house short-term and amended its zoning bylaws to explicitly prohibit rentals shorter than 30 days. Styller appealed to the zoning board, but it affirmed the cease-and-desist order. Styller appealed to the Massachusetts Land Court, arguing that his right to rent short-term should be allowed as a grandfathered accessory use under the zoning bylaws.
