Facts
In his will, Charles Wallace appointed his wife, Ruth (plaintiff) as the executrix of his estate and Jacqueline Goldberg as the attorney for Ruth and the estate. Louisiana Revised Statute (La.R.S.) 9:2448 provided that an attorney designated by a testator in his will could be removed only for just cause. After Charles died, Ruth sought (1) to have La.R.S. 9:2448 declared unconstitutional because it conflicted with the Louisiana Supreme Court’s rules regulating the attorney-client relationship and (2) to be able to discharge Goldberg and retain an attorney of her choice. The district court denied relief, and the court of appeal declined to exercise jurisdiction. The Louisiana Supreme Court granted certiorari.
