Facts
Sullivan & Donovan, L.L.P. (Sullivan) (plaintiff) sued Kenneth Bond (defendant) in the Supreme Court, Westchester County. Bond filed a motion in the Supreme Court, Bronx County pursuant to Civil Practice Law and Rules (CPLR) § 511(a) to change the venue to New York County. Sullivan cross-moved in the Bronx court for venue to remain in Westchester County. The Bronx had no other connection to the litigation. However, § 511(a) permitted motions to be filed in counties adjoining the judicial district in which the case was pending. The Bronx County adjoined Westchester County.
